General terms and conditions, right of cancellation and data protection


The following translation from the German original "Allgemeine Geschäftsbedingungen" (hereinafter called AGBs) is for information only. The AGBs are effective in the German version.

General terms and conditions

1. Scope of Application
The AGBs apply in accordance with German law (§ 305 German Civil Code (BGB)) for all contracts concerning the delivery of goods or the performance of services and concluded between an entrepreneur and a consumer. The AGBs are effective in the version valid at the time of ordering. The application of the AGBs is hereby agreed upon.

Deviating conditions of a customer are only accepted with explicit and written affirmation by Kunst-Griff Linda Schilling und Michael Wlotzka GbR (hereinafter called Kunst-Griff).

3. Your Order
Our offers are in respect of price, availability and time of delivery subject to confirmation and non-binding.
The sales contract between you and Kunst-Griff becomes effective after Kunst-Griff has accepted your order by order confirmation resp. delivery.

The product information displayed in brochures, catalogues, data files or any similar documents or made with any other offer (like pictures, drawings, descriptions, specifications of dimensions, weight, performance or consumption) are non-binding. This applies in particular to the case of modifications and improvements serving technical progress. Minor deviations from such product information are considered to be approved and do not affect the fulfilment of contracts, as far as they are not unsuitable for the customer.

4. Payment and Delivery
All our prices include the legal VAT and do not include shipping costs.

You have the following payment options:
- advance payment by bank credit transfer
- advance payment by PayPal

According to your wishes you can pick up the ordered goods in our workshop or we deliver at your request.

Deliveries to a country outside of the European Union are not subject to German VAT (tax-free export). However, there may arise import taxes and duties for you to pay to the respective customs and/or tax authorities.

5. Retention of Title
Until full payment the goods remain the property of Kunst-Griff Linda Schilling und Michael Wlotzka GbR.

6. Return Policy
According to German Civil Code (§ 355 BGB) consumers have a right of cancellation. The "Widerrufsbelehrung" is effective in the German version. The following is a translation from the German original for information only.

Information of customer's right of cancellation

Right of Cancellation

You have the right to cancel your declaration of contract within one month, without stating a reason, in written form (e. g. letter, fax, e-mail) or - if you received the good before expiry of the term - also by returning the good. The stated period of time starts on receipt of this information in written form, however not before receipt of the good at the consignee (for recurring consignment of similar goods not before receipt of the first part-delivery) and also not before performance of our obligation of information according to article 246 § 2 in connection with § 1 section 1 and 2 EGBGB as well as our obligations according to § 312g, section 1 sentence 1 BGB in association with article 246 § 3 EGBGB. To comply with the stated period of time it is sufficient to dispatch the cancellation or the goods in time. The cancellation has to be send to:

Effects of Cancellation

In the event of an effective cancellation the mutually provided goods and services shall be returned and, if applicable, any benefits enjoyed (e. g. interest) surrendered. In case you cannot return the received goods, or services, or benefits (e. g. benefits from use) in total or in part or only in deteriorated condition, you have to, if applicable, provide compensation insofar. You do not have to compensate for a deterioration caused by the utilisation of the good as intended. You have to provide compensation for benefits enjoyed only insofar, as you have used the good in a way that goes beyond inspection of characteristics and functionality. "Inspection of characteristics and functionality" is defined as the testing and checking of the respective good as it is possible and customary, for instance, in a retail shop. Goods that can be dispatched as parcels have to be returned at our risk and expense. Goods that cannot be returned as parcels will be collected from your address. Obligations for refunding of payments must be fulfilled within 30 days. The stated period of time starts for you with the dispatch of your declaration of cancellation or of the good, for us with their receipt.

7. Warranty
Warranty is governed by the legal regulations.

Please note: Wood is a natural product and can show differences in colour and irregularities caused by wood growth. Deviations in structure or colour are reserved, as far as they are caused by the nature of the used materials and customary in the trade. Wood can change its volume. This can cause distortions, inaccurate fitting and appearance of cracks. Due to the nature of the purchased good (unique) a replacement of a faulty good is only possible in so far as the customer can choose another available model. Any differences in price will be mutually compensated.

8. Liability
Liability is governed by the legal regulations.
If in accordance with legal regulations and these conditions Kunst-Griff has to answer for damages resulting from a simple negligence, liability of Kunst-Griff is limited. Liability is limited to breach of fundamental contractual obligations and to typical damage foreseeable at the time of contract conclusion. This limitation does not apply to the case of injury of life, body or health. The same applies to damages due to a fault of the purchased good.

9. Place of Fulfilment
Place of fulfilment is Berlin. The law of the Federal Republic of Germany shall apply exclusively.

10. Safeguarding Clause
If a provison of these General Terms and Conditions (AGBs) is invalid, the validity of the remaining provisions shall not be affected.

Data protection

Personal data is, of course, handled as confidential. You explicitly agree to the collection, processing and use of your personal data. At all times you have the right to information, correction, deletion resp. blocking of your stored personal data.

Personal data is only collected insofar it is needed to process your order. We do not pass any personal data to third parties, except for the service partners required to process your order. In these cases, we strictly follow the provisions of the Federal Data Protection Act. The transmission of data is limited to a minimum.
